Terms of Use of the Content of the Falper.it Website and Reserved Area<\/strong><\/h2>\n<\/div><\/div>

  1. Ownership of Content and Copyright<\/strong><\/li>\n<\/ol>\n

    All content available on the Falper.it<\/strong> website and\/or within the Reserved Area<\/strong>, including, by way of example and without limitation, the \u201cFALPER\u201d trademark in all its representations, CAD and BIM files, technical data sheets, assembly instructions, catalogues, price lists, product images, finish images, material and setting images, technical drawings, renderings, texts and any other digital material (hereinafter referred to as the \u201cContent<\/strong>\u201d), is the exclusive property of Falper S.R.L.<\/strong> or licensed to Falper by the respective rights holders.<\/p>\n

    Such Content is therefore protected by the applicable regulations on copyright, intellectual and industrial property<\/strong>, including, by way of example and without limitation, the provisions of Law no. 633 of 22 April 1941<\/strong> on copyright and Legislative Decree 30\/2005, known as the Industrial Property Code.<\/p>\n

      \n
    1. Grant of Limited Use<\/strong><\/li>\n<\/ol>\n

      Access to the website and to the Reserved Area (the latter intended exclusively for designers and industry professionals) grants the user a limited, non-exclusive, non-transferable and revocable right of use<\/strong>, solely for professional purposes connected with the development of projects including Falper products.<\/p>\n

      In particular, the material may be used solely for design, specification, technical prescription and presentation activities concerning Falper products and, in the case of retailers, exclusively within the scope of the existing commercial relationship with Falper<\/strong>.<\/p>\n

      Any use other than that indicated above shall be considered prohibited.<\/p>\n

      1. Prohibition of Use for E-commerce and Online Sales<\/strong><\/li>\n<\/ol>\n

        It is expressly prohibited<\/strong>, unless prior written authorization from Falper S.R.L.<\/strong> has been obtained, to use, publish, reproduce or disseminate in any form, whether analogue or digital, the Content of the website and of the Reserved Area. Therefore, the use of such Content is specifically prohibited, by way of example and without limitation, on e-commerce<\/strong> websites, marketplaces, online sales platforms or similar tools, and the association of one or more pieces of Content with competing companies or their products is strictly prohibited.<\/p>\n

        The use of the Content for the online sale<\/strong> of Falper products, for independent commercial promotion, for digital advertising campaigns or for any purpose involving sales activity or an offer to the public not expressly authorized in writing by Falper is also prohibited.<\/p>\n

          \n
        1. Prohibition of Reproduction, Modification and Transfer to Third Parties<\/strong><\/li>\n<\/ol>\n

          The reproduction, even partial, modification, adaptation, alteration or reworking of the Content is prohibited, as is its transfer, distribution or making available to third parties, even free of charge.<\/p>\n

          Any use that may compromise the integrity of the Content, alter the characteristics of Falper products or create confusion regarding the origin, identity or market positioning of Falper and therefore its corporate image is also prohibited.<\/p>\n

          1. Use of Product and Finish Images<\/strong><\/li>\n<\/ol>\n

            Without prejudice to the foregoing, the user who registers and accesses the Reserved Area of the Website is responsible for the use of the Content carried out through their own access credentials, which they undertake to keep confidential and protect with the utmost diligence, avoiding any improper or unauthorized use.<\/p>\n

            In any case, the registered user shall be liable for any use that does not comply with these conditions, even if carried out by third parties who have accessed the Content using their credentials, unless they prove that the cause is not attributable to them.<\/p>\n

            1. Intellectual and Industrial Property of the Products<\/strong><\/li>\n<\/ol>\n

              Falper reserves the right to suspend or revoke access to the Reserved Area at any time and without notice in the event of a breach of these conditions, without prejudice to the right to take action before the competent authorities to protect its rights and to seek compensation for any damages.<\/span><\/p>\n

              1. User Responsibility and Access Credentials<\/strong><\/li>\n<\/ol>\n

                Falper reserves the right to modify, update or remove the Content of the website and of the Reserved Area at any time. The Content is intended solely for informational, illustrative and technical purposes and may not faithfully represent the characteristics, finishes, accessories or equipment of the products described. The Content therefore does not constitute an offer to the public (Art. 1336 of the Italian Civil Code), nor a contractual proposal, nor a binding commitment. The submission of requests through contact forms, e-mail or other channels in relation to the Content shall under no circumstances imply automatic acceptance by Falper or confirmation of availability.<\/span><\/p>\n

                1. Suspension and Revocation of Access<\/strong><\/li>\n<\/ol>\n

                  Browsing the Website and any use of the Content are governed by these terms of use, which shall be deemed automatically accepted by accessing the Website. Furthermore, the user who registers and accesses the Reserved Area, as well as any user who downloads Content available in the Reserved Area, expressly declares that they have read and fully accepted<\/strong> these terms of use, which constitute a binding agreement between the user and Falper S.R.L.<\/span><\/p>\n

                  1. Content Updates and Limitation of Liability<\/strong><\/li>\n<\/ol>\n

                    These conditions are governed by Italian law<\/strong>. Any dispute shall be subject to the exclusive jurisdiction of the Court of the registered office of Falper S.R.L.<\/strong><\/span><\/p>\n

                    Falper reserves the right to modify, update or remove the content of the website and of the Reserved Area at any time. The materials are intended for informational and technical purposes and do not constitute a binding contractual offer<\/strong>.<\/p>\n

                    1. Acceptance of the Conditions<\/strong><\/li>\n<\/ol>\n

                      Access to the Reserved Area, registration and downloading of the content imply that the user has read and fully accepted<\/strong> these terms of use, which constitute a binding agreement between the user and Falper S.R.L.<\/p>\n
